Central Highlands Regional Council (CHRC) is obliged to comply with the provisions of the Information Privacy Act 2009. Council is collecting your personal information, namely photographic images, videos and/or audio recordings in the course of undertaking associated CHRC functions and services. CHRC regularly reproduces photographic images, video recordings or audio recordings of individuals in its publications, promotional and marketing material, including in videos, catalogues, magazines, newspaper articles, brochures and social media and on Council’s website (“Promotional Material”). These images and recordings are used to promote the Council or describe its activities. Council may wish to use photographic images, videos and/or audio recordings of yourself in future within Promotional Material and is seeking your consent to do so.
Your consent:
1. I declare that I am the parent/ legal guardian of the above children/children’s names (if applicable)
2. I agree to CHRC, its employees, officers, agents and contractors: making images or recordings, whether sound, digital or otherwise, of me and/or my child(ren) (‘Images and Recordings’) using, publishing or reproducing the Images and Recordings in any form (in whole or part) and by any medium, including but not limited to newspapers, magazines, brochures, television advertisements, promotional videos, websites, the internet (including third-party sites, such as social media e.g. Facebook, Instagram, YouTube, Vimeo etc.), CD-ROM or other multimedia, for public relations, promotions, commercial and advertising purposes (“Promotional Materials”) and retaining or storing the Images and Recordings (including those incorporated into promotional materials), in hard copy or digitally, including but not limited to, deposit of the Images and Recordings into the CHRC multimedia library;
3. I agree that the rights granted to CHRC under clause 2 of this Consent Form are perpetual and that I will not receive any payment, royalty or other consideration (whether monetary or otherwise) from CHRC in connection with the making, use or storage of the Images and Recordings;
4. I agree to CHRC collecting, storing, handling, accessing, managing, transferring, using and disclosing personal information about me and the Children, including but not limited to our name, details and image, in connection with the Images and Recordings or the Promotional Materials;
5. I waive the right to inspect, review or approve the finished videos, photpgraphs, advertising copy or printed matter prior to being published or reproduced by CHRC and approve the eventual Promotional Use to which they may be applied;
6. I agree that CHRC is the owner of the copyright in the Images and Recordings and the physical Images and Recordings;
7. I authorise any third party (third party partner) authorised by CHRC to use and reproduce the Images and Recordings in any Promotional Materials, for an unlimited period, for the positive promotion of CHRC;
8. I agree to release and indemnify CHRC and any third party from any liability, loss, damage, cost, expense, or claim arising out of the use, publication or reproduction of Images and Recordings or other information about me and/or my child(ren), including action for defamation, libellous material, breach of privacy, or copyright; and
9. I acknowledge I have read and understand this Consent Form and am signing this of my own free will.
10. I consent to my personal information being used for Promotional Material, including but not limited to being published on Council’s website and social media. I acknowledge that these sites will be available outside of Australia and may not be subject to the protection afforded by Australian privacy laws
